NatureofWorkExperience

As a resident of Salt Lake City, Utah, my legal practice has required providing legal advice tailored to commercial ventures including various aspects of intellectual property and related risk management, asset exploitation and protection. This has required analysis of not  only intellectual property issues but corresponding technology transfer, employment agreements; supply contracts; technology licenses; affiliated party transactions; joint venture agreements; confidentiality, non-compete and noncircumvention agreements; legal compliance; domestic and international manufacturing and distribution agreements and other commercial business agreements, use of public records and protection of personal likeness, image and privacy.

Experience drafting and negotiating myriad contracts and agreements.  Conducted and managed litigation in federal courts across the United States and in Utah and California state courts. Participated in various single party and complex multi-party dispute resolution mechanisms including mediation and arbitration, both formal and informal.

Contributed to strategic planning, policies and procedures development, performed risk management assessment using decision tree analysis and other analyses. Estimated, budgeted and managed legal costs for client matters.  Identified options for providing legal advice for particular matters at different price structures to meet client objectives and to maximize cost- benefits for client commercial endeavors.

Worked with other legal staff, joint defense teams and co-counsel to ensure effective, cost-effective working relationships and where permitted or advisable to share business and/or legal information. Served as lead counsel, local counsel and co-counsel. Managed external legal resources.

Participated in advising boards, senior management, leadership teams, marketing departments and research and development teams related to strategic business planning, market position and policy considerations.

Advised clients regarding internal best practice and procedure to safeguard company processes, data, assets, trade secrets, etc. and to avoid potential liability or losses.

Facilitated and managed providing legal advice for statutory and corporate requirements. Conducted management and employee training seminars to ensure compliance with current and changing legal obligations.

Served in law firm positions and small company management teams and advisory boards for performance and administrative management and for employee development and mentoring.

My practice in the state and federal courts, before the United States Patent and Trademark Office including the Trademark Trial & Appeal Board and before the United States Trade Commission has related to a variety of electro-mechanical, chemical products, computer technology devices and processes and addressed patent, trademark, copyright, unfair competition, false advertising, internet, trade secret, trade dress, licensing, contracts and employment matters.
